Agreement to Terms

These Terms of Use constitute a legally binding agreement between you and ToujourMikes, operating through toujourmikes.delivery. By accessing our website, enrolling in our culinary programs, or using any of our professional culinary education services, you acknowledge that you have read, understood, and agree to be bound by these terms.

Our culinary education platform provides comprehensive training in professional cooking techniques, food safety protocols, and industry best practices. These terms govern your participation in our programs and your use of all related educational materials and resources.

Educational Services and Programs

ToujourMikes offers professional culinary education programs designed to develop practical cooking skills and industry knowledge. Our programs include hands-on training, theoretical instruction, and practical application opportunities.

Program Expectations

While our programs provide comprehensive culinary education and skill development opportunities, we cannot guarantee specific career outcomes, employment placement, or income levels. Success in the culinary industry depends on individual effort, market conditions, and various external factors beyond our control.

  • Program enrollment is subject to availability and prerequisite requirements
  • Students must maintain regular attendance and participation standards
  • All culinary techniques and safety protocols must be followed precisely
  • Professional conduct is expected in all learning environments
  • Equipment and facility usage must comply with established safety guidelines

User Responsibilities and Conduct

As a participant in our culinary education programs, you agree to maintain professional standards and respect for fellow students, instructors, and staff members. This includes arriving prepared for classes, following safety protocols, and contributing positively to the learning environment.

  1. Attend all scheduled classes and practical sessions punctually
  2. Complete assigned projects and assessments within specified timeframes
  3. Maintain proper hygiene and follow food safety regulations at all times
  4. Treat all equipment, facilities, and ingredients with appropriate care
  5. Respect intellectual property rights of instructors and fellow students
  6. Communicate professionally with staff and maintain confidentiality when required

Important: Culinary education requires physical activity, handling of hot equipment, and exposure to various food allergens. Students must disclose relevant health conditions and allergies before program participation.

Payment Terms and Refund Policy

Program fees must be paid according to the payment schedule provided during enrollment. We offer various payment options to accommodate different financial situations, and payment plans may be available for qualified applicants.

Refund Policy

Refunds are processed according to the timing of withdrawal from programs. Students withdrawing within the first week of instruction may receive a full refund minus administrative fees. Partial refunds may be available for withdrawals occurring within the first month of instruction, calculated based on completed instruction time.

No refunds are available for students who withdraw after completing more than 50% of program instruction. All refund requests must be submitted in writing and include documentation of circumstances requiring withdrawal.

Intellectual Property and Materials

All educational materials, recipes, techniques, and instructional content provided through our programs remain the intellectual property of ToujourMikes and our instructors. Students receive limited rights to use these materials for personal learning and skill development.

  • Educational materials may not be reproduced or distributed without permission
  • Recipe formulations and proprietary techniques are confidential information
  • Students may not record classes without explicit instructor consent
  • Commercial use of learned techniques and recipes is permitted after program completion
  • Attribution to ToujourMikes is appreciated but not required for personal use

Health, Safety, and Liability

Culinary education involves inherent risks including exposure to heat, sharp instruments, and potential allergens. Students participate in all activities at their own risk and must follow safety protocols established by our instructors and facility management.

Students are responsible for disclosing any medical conditions, allergies, or physical limitations that might affect their ability to participate safely in program activities. We maintain comprehensive insurance coverage, but students are encouraged to verify their personal insurance coverage for educational activities.

Safety Requirements

All students must complete safety orientation before beginning hands-on instruction. Proper culinary attire including closed-toe shoes, aprons, and hair restraints are mandatory during practical sessions. Students who fail to follow safety protocols may be removed from class activities.

Privacy and Data Protection

We collect and maintain student information necessary for program administration, including contact details, emergency contacts, health information relevant to safe participation, and academic progress records.

Student information is protected according to Canadian privacy legislation and is not shared with third parties except as required for program administration or legal compliance. Students may request access to their records and corrections to inaccurate information.

Photos and videos taken during classes may be used for promotional purposes unless students specifically opt out of such use during enrollment.

Program Changes and Cancellations

ToujourMikes reserves the right to modify program schedules, content, or instructors when necessary due to circumstances beyond our control. We will provide reasonable advance notice of significant changes and work with affected students to minimize disruption.

  • Schedule changes will be communicated at least 48 hours in advance when possible
  • Substitute instructors may be provided when regular instructors are unavailable
  • Program cancellations due to insufficient enrollment will result in full refunds
  • Weather-related closures will be rescheduled without additional fees
  • Content modifications to improve educational quality may occur during programs

Termination and Suspension

We reserve the right to suspend or terminate student enrollment for violations of these terms, disruptive behavior, safety violations, or non-payment of fees. Students may also voluntarily withdraw from programs according to our withdrawal policy.

Termination for cause will not result in refunds of paid fees. Students terminated for safety violations may be prohibited from future enrollment in our programs.

Limitation of Liability

ToujourMikes provides culinary education services and makes reasonable efforts to ensure quality instruction and safe learning environments. However, we cannot guarantee specific outcomes, career advancement, or business success for program graduates.

Educational Outcomes

While our programs provide comprehensive culinary training, success in the food service industry depends on many factors including individual skill development, market conditions, location, and business acumen. We do not guarantee employment placement or specific income levels for graduates.

Our liability is limited to the amount of fees paid for the specific program in question. We are not liable for indirect, consequential, or punitive damages arising from program participation or use of our facilities.

Governing Law and Dispute Resolution

These terms are governed by the laws of Ontario, Canada. Any disputes arising from these terms or program participation will be resolved through binding arbitration in Toronto, Ontario, unless both parties agree to alternative dispute resolution methods.

Students are encouraged to first attempt resolution of concerns through direct communication with program administrators before pursuing formal dispute resolution procedures.

Updates to Terms

These terms may be updated periodically to reflect changes in our programs, legal requirements, or business practices. Students will be notified of significant changes through email or posted notices at our facility.

Continued participation in programs after term updates constitutes acceptance of the revised terms. Students who do not agree to updated terms may withdraw according to our standard withdrawal policy.
